The Civil Service Commission: A Comparative Perspective

The Civil Service Commission is among the most important and influential bodies regarding the functioning of the public service in Israel. The Commission holds extensive powers in the domains of recruitment and screening for the civil service, including senior appointments, setting standards and codes of conduct for civil service employees, reward and promotion mechanisms, and training employees and managers. As the central body in managing human capital in the public service, the Commission constitutes a vital factor in ensuring the professionalism and state-oriented (mamlachti) character of the public system. In recent years, against the backdrop of data indicating a decline in various human capital metrics in the civil service and failures in implementing reforms, questions have arisen regarding the governance and management structure of human capital in the civil service, focusing on the Commission as the central staff body for this issue.

Introduction

The nature of the current era is that many discussions are reduced to political-identity or personal issues, and maintaining a substantive discussion based on data is difficult. A good example of this is the controversy that erupted toward the end of the term of Civil Service Commissioner Prof. Daniel Hershkowitz, revolving around the Commissioner’s appointment method and including the debate over the acting commissioner, which turned into a deep dispute between the Government of Israel and the Attorney General’s Office, resulting in the appointment being delayed until an acting commissioner was ultimately appointed to the role. The purpose of this paper is to attempt to generate an alternative discourse on the civil service based on data and a comparative review of human capital management staff bodies in other countries, in order to derive objective insights and lessons regarding existing gaps in the civil service in Israel.

The comparative examination will provide a useful perspective for thinking about structural questions concerning the Civil Service Commission, including its roles, its powers vis-à-vis government ministries and executive branch bodies, the legal basis for its activity, existing structural balances for preserving accountability, professionalism, and state-oriented character, and more. It will also address the most topical issue at the time of writing these lines—the method of appointing the officeholder heading the Commission.

Conclusion

The Civil Service Commission is an institution of immense importance, directly impacting the quality and professionalism of the public service. The comparative review reveals substantive differences between the Israeli Commission and similar bodies in comparison countries, pointing to the need for a significant reform in the Israeli Commission. Across all comparison countries, commissions are characterized by an independent structure enabling them to operate without dependence on the government or political actors. Furthermore, unlike Israel, commissions in all comparison countries operate within solid and clear legal frameworks that well define the Commission’s roles and the boundaries of its powers. Moreover, commissions in these countries concentrate on strategic tasks such as long-term policy management and development, guidance, and supervision over domains such as skills development, workforce planning, and efficient public policy.

Conversely, in Israel the situation is more complex, and the Commission contends with substantive structural challenges. A central challenge is the Commissioner appointment process, where political influence is evident, undermining the requisite independence of the Commission. Additionally, the Israeli Commission is occupied with the daily, routine management of workflow processes in ministries and governmental units instead of focusing on strategic direction and comprehensive supervision over the public service’s functioning. Consequently, the Commission’s ability to influence the development of the public service and instill principles of long-term planning, transparency, and professionalism is impaired.

In light of these differences, the importance of a broad structural reform emerges that will enable the Civil Service Commission in Israel to adopt principles from successful civil service commissions globally. This reform can include defining a clear legal framework that will preserve the Commission’s independence, setting transparent rules for appointing a commissioner based on qualifications alone, and shifting the focus of the Commission’s areas of responsibility to strategic planning and supervision of public service policy. These steps will strengthen the Commission’s ability to lead a substantive change in the public service, establish a professional and transparent organizational culture, and increase public trust in public service management. In this manner, the public service in Israel will be able to cope with future challenges efficiently and professionally, providing citizens with quality service tailored to the changing needs of Israeli society.
